Welcome to Product Compliance Lab
These Terms of Service ("Terms") govern your access to and use of our services, including our various websites, APIs, email notifications, applications, buttons, and widgets (the "Service" or "Services"), and any information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as "Content"). Your access to and use of the Services are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.
1. Basic Terms
You must be at least 18 years old to use the Service, (or any greater age required to be deemed to have reached the age of majority under the applicable law of the state or jurisdiction of your residence).
You are responsible for the safety and security of your account; use a strong password and limit its use to this account.
You agree to use the Services only for purposes as permitted by these Terms and any applicable law, regulation, or generally accepted practice in the applicable jurisdiction.
You are solely responsible for all activity that occurs (including any charges incurred) on your account, and we may assume that any activity under your account was made by you.
2. Privacy
Any information that you or other users provide to Product Compliance Lab is subject to our Privacy Policy, which governs our collection and use of your information.
3. Content on the Services
All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content.
We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content.
You are responsible to ensure that any content you provide on the platform is correct, free from profanity and free of any copyrights or other restrictions.
4. Restrictions on Content and Use of the Service
We reserve the right at all times (but are not obligated) to remove or refuse to distribute any Content on the Services and to terminate users or reclaim usernames without liability to you.
5. Free Services
A certain number of features and functionalities are made available to you at no cost ("Free Service"). The features and functionalities of the Free Service are described in the App. We reserve the right to change or discontinue features and functionalities of the Free Service or move them to our Premium Service at our free discretion.
6. Premium Services
In addition to the Free Service we provide additional features and functionalities on a monthly or yearly subscription basis ("Premium Service"). The features and functionalities of the Premium Service are described in the App. You have the option of testing the Premium Service for free for the duration described in the App ("Free Trial"),
You may purchase a Premium Service subscription directly from Product Compliance Lab or Alura Group in our App, or through a third party, such as the Apple App Store or Google Play Store. When you purchase a subscription through a third party, your purchase is also subject to the terms and conditions of that third party.
When you purchase a subscription directly from Product Compliance Lab or Alura Group, we will ask you to provide a payment method. By signing up for the Premium Service, you authorize us or the applicable third party to automatically charge your payment method on a yearly or monthly basis, depending on the type of your subscription you chose. Charges will be made for the then applicable subscription charge, plus any applicable taxes and fees.
Your Free Trial will automatically extend to a Premium Service subscription, unless you cancel at least 24h before your Free Trial ends. Your subscription will automatically renew at the end of the applicable subscription period, unless you cancel at least 24h before the current subscription period ends. The extension period will be for the same duration as the former subscription period, i.e. one month or one year. You can cancel the subscription by following the cancellation flow within the app.
7. Third Party Sites
The Service may contain information and content provided by third parties (e.g. when listening to a podcast or watching a video), and links to and integrations with third party websites, applications, services, content, feeds and other resources that are not owned or controlled by Product Compliance Lab or Alura Group (collectively, “Third Party Sites”). Product Compliance Lab and Alura Group are not responsible for the availability of such Third Party Sites and does not endorse and is not responsible or liable for such Third Party Sites. If you access Third Party Sites from the Service, you do so at your own risk, and you understand that these Terms and our Privacy Policy do not apply to your use of such Third Party Sites and that third party terms and policies may apply.
8. Changing These Terms
Product Compliance Lab may, from time to time change or amend these Terms of Service. We will inform you in an appropriate way prior to the effective date (e.g. by e-mail or pop-up-message). Notwithstanding the terms of this paragraph, no revisions to the Terms of Service will apply to any dispute between you and Company that arose prior to the effective date of such revision. By continuing to use Product Compliance Lab after such change, you accept the new Terms of Service.
9. Termination
You may end your legal agreement with Product Compliance Lab at any time by deactivating your accounts and discontinuing your use of the Services.
We may pause, suspend or terminate your access to or use of the Free Service, or any part thereof, or close your account, at any time in our sole discretion without notice to you, including without limitation if we determine you have violated these Terms of Use.
We may pause, suspend or terminate your access to or use of the Premium Service, or any part thereof, or close your account, at any time if you fail to pay the charges in a timely manner or if you have otherwise violated these Terms of Use.
10. Disclaimers and Limitations of Liability
The Services are Available "AS-IS"
All warranties and claims (express or implied) are disclaimed unless required by law.
Product Compliance Lab does not assume any liability for direct or indirect damages caused by the use of Product Compliance Lab or in connection with the Service, to the maximum extent permitted by the applicable law.
In case of violation of these Terms of Service as well as in case of infringement of rights and corresponding claims of third parties, you expressly release Product Compliance Lab from any liability and will fully indemnify Product Compliance Lab for damages and costs incurred.
11. General Terms
These terms will be governed by the laws of the Netherlands, without regard to its conflict of laws principles.
